General policy on the processing of personal data - version 2026/03

Moti SRL places great importance on the protection of personal data that it processes in the course of its activities. We make every effort to ensure the secure, transparent and confidential processing of the personal data of our clients, prospects and visitors to our website – hereinafter referred to as the Data Subjects. We also ensure that only necessary and lawfully obtained data is processed.

This general policy aims to inform any Data Subject about the processing of their Personal Data in the context of the use of our services. We collect and process your personal data in accordance with Belgian legislation and the applicable European legislation – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, hereinafter referred to as the GDPR.

Before transmitting Personal Data, we ask you to carefully read the content of our general policy and to indicate your acceptance of its content. Failing this, you may refrain from using our services and from providing us with personal data.

The Company may amend this general policy at any time; where applicable, we will ask you to indicate your agreement to the new version. The number indicated in the header allows the applicable version to be identified.

2. What personal data do we process?

2.1. For the processing of your information requests, your subscription to our newsletter and promotions, we collect and process the following data: title, surname, first name, email address and telephone number.
This data is collected on the basis of your prior consent. You may therefore withdraw your consent and request that we delete this data if no legal obligation requires us to retain it.

2.2. For the processing of your orders, we collect and process, in addition to the data mentioned in point 2.1, your billing and delivery addresses, your VAT number and your company number.
This data is collected on the basis of your consent and is then processed for the purpose of performing the contract.
This data will only be used for the purposes for which it was collected, namely to fulfil the sales contract concluded with you, and will be retained for as long as we are legally required to keep it.

2.3. We process certain categories of personal data in order to manage the technical operation of our website, improve your user experience and enhance the marketing effectiveness of our website.

The user of the website is fully responsible for the accuracy of the data they provide; the Company cannot under any circumstances be held liable for data that has been provided incorrectly or as a result of identity theft.

4. Access to and transfer of personal data

The data collected is accessible to our staff and employees who carry out the intended processing on our behalf. They are aware of the importance of this personal data and are contractually bound to use it only for the purposes for which it was provided. As far as possible, and taking into account the size of our company, we restrict access to personal data so that each employee only has access to the data necessary for the performance of their duties.

Personal data may also be transferred to external service providers to whom we contractually require compliance with the same obligations as ours regarding the processing of your personal data. By default, we favour service providers established within the European Economic Area – EEA so that they are subject to European legislation – GDPR. Failing this, we only authorise the transfer of personal data outside the EEA to third countries with an adequate level of protection.

Your personal data may also be disclosed to other third parties such as judicial or administrative authorities pursuant to a binding order or legal obligation.

Finally, we undertake not to sell or make available to prospecting companies or any other type of marketing entity the personal data we have collected.

5. Security of your personal data

We implement all technical and organisational measures in line with best practice to ensure the security of the personal data we collect and process. We regularly review our processes in order to adapt them to market developments.

We also comply with all GDPR requirements in the event of loss, corruption or accidental transfer.

Finally, the user acknowledges that the transmission of data over the Internet involves certain risks; the Company cannot be held liable for any damage you may suffer as a result of a third party during your use of the Internet.

6. Rights of the data subject

Belgian and European legislation provides various rights for the data subject:

6.1. The data subject may request free access to the data we have collected about them. Where appropriate, they may request its rectification.

6.2. The data subject has the right to be forgotten. However, this right will not apply if the data must be retained in accordance with a legal obligation.

6.3. The data subject may object to the processing of their personal data provided this does not conflict with a legal obligation incumbent upon us.

6.4. The data subject has the right to receive the personal data concerning them that we have collected in a commonly used format in order to enable its portability by transferring it to another party at their own initiative.

In the event of a dispute concerning the collection and processing of your personal data, we invite you to inform us and we undertake to make every effort to ensure that all your rights and obligations are respected.

If, despite all our efforts, you believe you have grounds for complaint regarding the processing of your personal data, we inform you that the Data Protection Authority may receive your complaint:
